It was absolutely inevitable that this type of service would eventually be offered. Many people, especially small business owners and individuals, are only too aware of how quickly legal bills can mount for even minor matters.
As a result, they may delay taking the necessary steps to protect their business or personal assets from legal assault and make sure that the business dealings they negotiate and legal documents they use and sign are up-to-date and in their best interest. But delay and avoidance can often prove expensive.
In an effort to market to those seeking affordable legal services, a number of prepaid legal companies have formed to offer legal services at preset fees (premiums) and/or discounted rates for those who belong to the plan.
The first step before signing up with a prepaid legal business program should be to check with the Bar Association or appropriate licensing department in the area to be sure the company is operating legally and living up to its promises and commitments.
It is always wise to do a bit of research by checking the reputations of at least a few of the attorneys who belong to the plan and provide their services in the area. It can be a definite plus to find attorneys on the plan who specialize in a particular business area, such as employee relations or labor negotiations, business liability, real estate or contract law.
Some group plans are offered that cater to specific industries or their employees and many have well laid out plans that describe precisely which services are offered and how many uses of the different services are covered yearly in each plan. Another item to be considered is any caps on services, after which the plan member must pay part or all of the costs.
Normally, these costs for members should be at reduced rates from the standard fees the attorney would charge non-plan members. It might work out well to have a different attorney responding to each need, but some users may feel it is important to have a regularly assigned contact attorney, at least for initial consultations, before being referred to another plan attorney.
If the prepaid legal company offers a customer service department to help with these matters, many members would find that as a plus as well.
Costs and benefits should be carefully reviewed and compared with other legal services offered by other groups and for profit companies. This may be somewhat tricky as there is no industry standard for such plans and the offerings and premiums can vary quite a bit. One should also do a personal cost vs. benefit analysis to see if the services most likely to be used by them are covered or are available at lower cost by some other means.
This is primarily a service business, though the service may also be offered as a form of insurance product used to guard against unlimited legal costs that one might incur and to prevent financial disasters due to legal losses.
